Welcome to TheBitShares (hereinafter “the Platform”). By accessing or using the Platform, including its arbitrage and affiliate programs, you agree to comply with these Terms and Conditions (“Terms”). The Platform is operated under Singapore law.
2. No Financial Advice / Risk Acknowledgment
The Platform does not provide investment advice and does not guarantee any returns.
Users acknowledge that arbitrage and cryptocurrency trading are high-risk activities, and all financial losses are solely the responsibility of the user.
TheBitShares, its affiliates, officers, and employees shall not be liable for any direct, indirect, or consequential losses, including but not limited to lost profits or capital, arising from the use of the Platform.
3. Global Access and Local Compliance
The Platform is accessible globally, subject to local laws and regulations.
Users are responsible for ensuring that their participation in the Platform complies with applicable laws in their country of residence.
Any illegal use of the Platform may result in suspension of accounts and reporting to relevant authorities.
4. Eligibility
Registration on the Platform is only permitted for adults who have reached the age of majority in their country of residence.
Users are strictly prohibited from creating multiple accounts or “duplicate accounts” to gain benefits from the affiliate program. Violations will result in termination of all associated accounts and forfeiture of any rewards.
5. Know Your Customer (KYC) and Verification
All users must successfully complete KYC verification prior to withdrawals.
The Platform may request additional documentation at any time to comply with regulatory obligations.
Failure to complete KYC may result in account restrictions or permanent suspension.
6. Regulatory Compliance
The Platform adheres to applicable cryptocurrency regulations, including but not limited to:
European MiCA Regulation
Singapore’s Monetary Authority (MAS) guidelines
International Anti-Money Laundering (AML) and Counter-Terrorism Financing (CTF) standards
Users must declare all gains and comply with local tax regulations.
7. Affiliate Program
The Platform offers an affiliate program subject to the following:
Affiliates must operate honestly and transparently.
Global sign-ups are permitted, subject to local laws.
Affiliates are prohibited from engaging in fraudulent, manipulative practices, or using duplicate accounts to exploit the program.
The Platform reserves the right to suspend, terminate, or withhold payments to affiliates violating these Terms or applicable laws.
8. Security and Platform Integrity
Users are responsible for maintaining the confidentiality of their account credentials.
The Platform implements standard security measures, including encryption and monitoring, but cannot guarantee complete immunity from cyberattacks.
The Platform reserves the right to suspend accounts temporarily for suspected security breaches.
9. Reporting Violations
Any suspicious or illegal activity may be reported to authorities and regulatory bodies.
The Platform reserves the right to take legal action against violators.
10. Limitation of Liability
The Platform, its owners, employees, and affiliates shall not be held liable for any losses or damages, whether arising from technical failures, market volatility, or user error.
Users expressly agree to assume all risks associated with participation in arbitrage and trading activities.
11. Amendments
The Platform reserves the right to update or modify these Terms at any time. Users are responsible for reviewing the Terms periodically. Continued use of the Platform constitutes acceptance of any amendments.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of Singapore. Any disputes shall be submitted to the competent courts of Singapore.
